Terms of Use
GPS Mapper
Overview
Provided by Nikolah. By downloading or using GPS Mapper (the “App”), you agree to these Terms of Use (“Terms”). If you don’t agree, please don’t use the App.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent where you live) to use the App. By using it, you confirm you meet this requirement.
License to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own personal, non-commercial use. You may not sell, rent, sub-license, redistribute, reverse-engineer, or copy the App or the data it provides, except as allowed by law.
Acceptable use
You agree not to use the App to break any law; to harass, stalk, or track any person without their clear consent; to infringe anyone’s rights; or to interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems. If you choose to share your location with others through the App, you decide who you share with and for how long — share only with people you trust, and you are responsible for those choices.
Subscriptions, billing & refunds
Some features require a paid subscription. Subscriptions are sold through Apple and billed to your Apple ID. They renew automatically at the price shown unless you cancel at least 24 hours before the current period ends. You can manage or cancel anytime in Settings → Apple ID → Subscriptions. Payments and refunds are handled by Apple under the App Store terms — we generally can’t issue refunds directly, and refunds are not provided for any unused portion of a subscription. We may change which features are free or paid over time.
Location accuracy & safety
The App relies on your device’s GPS and sensors and on third-party map data, all of which can be inaccurate, incomplete, delayed, or unavailable. Don’t rely on the App for navigation, emergencies, safety-of-life situations, or precise positioning. Always use official maps, signage, and your own judgment, obey all laws, and never let the App distract you while driving or doing any activity that needs your attention. You use the App, and engage in any activity you track with it, entirely at your own risk. Any fitness metrics the App estimates — such as distance, steps, or calories — are approximate and for general informational purposes only, and are not medical advice.
Your content & third-party services
You keep ownership of content you add, such as photos, image overlays, trails, pins, routes, and notes. You’re responsible for having the rights to that content and for keeping it lawful. You grant us a limited license to store, process, and sync your content — including through Apple iCloud/CloudKit — solely to operate the App for you. Map imagery, place data, and similar content are provided by Apple and other third parties under their own terms, and your use of those services is subject to those terms. The App and its original design and code are owned by us and protected by intellectual-property laws.
Disclaimer & limitation of liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON LOCATION, MAP, OR FITNESS DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM.
Changes to these Terms
We may update these Terms from time to time. We’ll post the updated version here with a new effective date. Your continued use of the App after changes are posted means you accept the updated Terms.
